My ex-boyfriend used one of my credit cards for a balance transfer 3 years ago, and left me with over $2000 of his debt to pay. I was a poor college student and couldn%26#039;t so it went into default and now it%26#039;s to a debt collector. He was going to make payments and never did, now, we%26#039;re broken up, not a cent has been paid and he%26#039;s refusing to work with me in paying it off. Its at over $3500 now with interest, etc., but destroying my credit which over wise in fine. Can I sue him in small claims? (I%26#039;m in Ohio). I%26#039;m just worried that since he has just recently lost his job, and has previously made references to filing for bankruptcy, that he will just do that once I do something. The balance transfer went from his card to mine, so there should be proof of this. Can the debt be transferred off my credit to his, and he be left with the collectors? I know a lawyer might be best in this situation but I can%26#039;t really afford it. And yes, I know how stupid I sound for letting this happen.

You can sue. The debit won%26#039;t be %26quot;transferred%26quot;; after all it is your debt. If you decide to sue, you may not win, you may rack up court fees, and you may end up with a judgement you can%26#039;t enforce if he doesn%26#039;t have anything to collect.

Stupid, yes, but there are a LOT of people that do this. yes, take him to small claims court and get documentation proving that the transfer was made.

Did you consent to the balance transfer? If you did, there may not be much you can do. If he did it w/o your consent, you may have some recourse. However, if you found out and didn%26#039;t do anything, you could have implied consent to his act. You really need to speak to an attorney. If you can%26#039;t afford one, seek out Volunteer Lawyer Associations in your state. They can hook you up with a pro bono (free!) attorney if you don%26#039;t make enough money. Listen, if you have no legal recourse, call the credit card company and see if you can work something out, or call a debt consolidation company to help you. It may be cheaper in the long run.

You can file a small claims action, but you will be limited to whatever their parameters are, which may be $1,000 or $3,000. It just depends on the local rules for small claims court.
If you get a judgment against him now, it%26#039;s unlikely he will be able to have that debt discharged by bankruptcy, so you need to hop to it and get your claim filed today. Otherwise, you%26#039;ll be stuck with the entire amount. You will need proof, though. Do not assume that the judge will just believe you, you will have the burden of proving he owes this money to you.
If he has any income, you may be able to find an attorney who will help you on a contingency fee basis. That way you won%26#039;t have to pay any money to the lawyer, they%26#039;ll take it out of your settlement.

The debt is yours. You let him do it at the time and now you have responsibility for it. However, that does not change the fact that he now owes you the principal plus the interest. That does not mean he owes the collector%26#039;s though. You owe them. You can not switch it back to him without him signing for it (which he won%26#039;t). You could sue and would probably win; however, if he were to file bankruptcy he would probably get out of having to pay you all of it (if not get out of everything). It%26#039;s a tough one but you need to accept that the debt is your responsibility and you are the only one being hurt (your credit) by not paying it. Pursue action against him and cross your fingers.
Lesson learned that you don%26#039;t assume someone%26#039;s else%26#039;s debt ever, for any reason. Exceptions to be made for husbands/wives but even then I would be hesitant to assume it 100%.

Did you let him do it in the first place? If so, then the debt is yours and the $2000 is in effect a gift from you to him. If he did it fradulently, you have done nothing for three years. You have no case.

your best bet is to work out a payment plan and pay it off
