Credit card debt: Pay with stocks/profit sharing?

Unfortanely, I have racked up credit card bills. I am roughly $6,000 in debt. I do have money going into my 401k, stock and other funds monthly. I am wondering if I should sell stock to pay off my credit card debt. I may be leaving my current company and could also take my profit sharing money versus rolling it over. I know I will have tax/fees with doing either of these. Doing one or the other would pretty much cover almost all of the credit card debt. Currently I make the minimum monthly payment on my credit card. Sometimes a little over. The interst rate is apprx. 12%. I wonder if using the stock or profit sharing would be wise or not. Once the credit card is paid I can stick the monthly credit card amount into savings or my 401k. What is the best thing to do? I had racked up credit card bills do to a medical situation and a few emergencies. All is good again and I want to be debt free. Any advice? Thanks.

I would not suggest it. Whatever funds you take out of a retirement account, will get slammed with back income tax, plus a 10% penalty. So taking $10,000 out would cost around 3,500-$4000. [1,000 penalty, and then $2500-$3000 in income tax (assuming 25-30% bracket)].

Eventually you will have to pay taxes on the money in your 401K no matter what so that in itself, should not be an issue. If you want to pay off your cards and have access to the money to do it I would highly recommend doing so. The credit cards will cost you more than taxes in the long run. If you choose to do that you should also destroy the cards, at least all but one and save that for EXTREME emergency. You can live without credit cards believe me.

First of all, I want everyone to know that I know I should not carry a balance on my credit cards at all, so let%26#039;s just get that out of the way. I have about $1,200 to pay towards my credit card debt and would like to know which cards I should focus paying first to best improve my credit score. I have heard you should pay the one with the highest APR first, or pay all down to below 30% of used credit, but I just want to know which will improve my score the most so that I can factor that in when making my decision.

Credit Card 1: $450 balance; Credit Limit of $500 (APR 14%)



Credit Card 2: $480 balance; Credit Limit of $500 (16%)



Credit Card 3: $1,100 balance; Credit Limit of $1,200 (21%)



I could pay off C.C. #1 and #2 completely, or pay off C.C. #3 completely and pay the other ones about $100 to pay them down, or, should I just pay some to each one? Psycologically, I would feel I accomplished more by paying at least one off completely. What do you think?

There are 2 schools of thought. One says that you pay off the one with the highest interest rate. This is the more traditional approach because that is the card that is costing you the most money in interest. Then you would have more money to pay each month on the other two smaller amounts.



The other school of thought says to pay off the two smaller ones, but still pay the same amount you were spending on CC payments to the 3rd one. Example, if you were paying $50 on CC 1, $50 on CC 2, and $75 on CC 3, then pay off CC 1 and CC 2, and put $175 on CC 3 every month.



Of course, you could still pay off CC 3 and put $125 on CC 2 and $50 on CC 1, then once CC 2 is paid off, put $175 on CC 1. It wouldn%26#039;t take you long to be debt free at this rate.

I must admit I don%26#039;t know how credit cards work over in the States as well as I know them here in the UK, but ver here, I recommend the following.



IMHO, look at the card that is costing you the most money i.e the highest interest rate. The sooner you pay that off, the quicker you%26#039;ll be able to pay the others. I recommend making the minimum payment the carrier will allow on cards 1 and 2, and paying as much as you can afford on card 3.



This is a good cycle, because as the balance of card three reduces, so willl the interest charges, allowing you to increase payments steadily, until all 3 cards are payed off.

Starting life with a bankrupcy doesn%26#039;t sound a very happy beginning to me, why not get a credit card with ZERO interest for 12 months then pay the debt with it?



However if you are not working this can be nothing more than a way of putting off the evitable but it will give you time asthough It really does little to correct the problem in the long term. That%26#039;s why many people come back to debt negotiation as a way of getting out of their financial problems and starting fresh start.

You can be sued and brought to court. You should not just hide. You%26#039;re already in a bad situation because the cards went into default. You need to try to work something out with the collection agencies. Or you could try working with a credit counseling service that will be able to negotiate with the card issuers - -make sure you find a non-profit or other low cost service (try your state%26#039;s consumer affairs office).



This is not a joke. I don%26#039;t know what your balances are but the collections people could put a lien on your car, your income -- even future earnings. And if you want a new car or a home someday it will be really tough for you.

Credit card debt is not like a student loan. The debt will be sent to a collection agency. I would recommend paying at least the minimum amount on the credit cards if at all possible. Another possible solution is speaking to a debt management agency. There are many that are not-for-profit and therefore do not charge for their services. Also, take it from someone a little older and still paying for the cheeseburger I charged my freshman year of college (circa %26#039;99). It is better to starve than use credit cards! Cut them up!

Here%26#039;s my situation: I have 3 maxed out credit cards totaling 35K (all debt to help a friend in need) and 60K of currently deferred grad school payments. I still have good/decent credit because my wonderful parents put me as an authorized user for all their cards since I was 10. I can%26#039;t thank them enough. Also, never had one delinquent, etc. The 0% on the cards have now expired and in pretty high rates.



I%26#039;m a full-time student and work full-time, but can%26#039;t show income because only been working two months and it%26#039;s a commission-based job. On track right now to make over 120K this year, but can%26#039;t work for the next month and need a credit line or free up one of the cards asap.



Can I move all CC debt into one account? What%26#039;s the deal with debt consolidation-will it affect my credit score? needed? How about yet another credit card? Any other companies that will see the maxed-out high limit cards and not freak? Any options being a student?

Those maxed out credit cards are taking a big bite out of your score -- or at least they will. Also the rules have changed and authorized users accounts are no longer being counted in your score -- credit bureaus have been phasing it in. You may find that you score is a couple hundred points lower than you thought.



You might try getting another credit card but you are really digging yourself a pretty deep hole. Maybe you should get that friend to start paying you back.

You should never exceed more than 25% of your credit limits. so, if you have a 100,000 dollar limit you should never owe the card more than 25,000 at one time. Have you looked at transfering al 3 credit cards to one credit card. You can get a 0% apr transfer credit card for the first 6 months. No interest for 6 months and once u get ure cheques in you can pay it off faster. Interest payments hurt

So, I decieded about a month ago that I NEED to take care of my credit card debt. So, I did the credit report, got a hold of my credit card co, and told them I needed to work a payment plan out, but I will pay. I did this in a letter to them...never heard anything back. I honestly just thought it took a long time for them to do paperwork. Well, today a letter came from a lawyer%26#039;s office stating I%26#039;m being sued over that debt. WHAT!!?? I called the lawyer%26#039;s office and he said that since my debt was forwarded to him there%26#039;s nothing I can do but see him in court. He sounded pretty mean too. Is there anything I can do?



-I only have 1 credit card.

First off...I don%26#039;t think you were sued. You are sued when you receive a summons and complaint from the county where you live. This will normally be a form signed by someone at the courthouse and must be SERVED to you either physically (typically by the sheriff%26#039;s office or local police or some other person authorized to do so) or via certified mail. But you must have this summons from the court, otherwise it%26#039;s really just junk mail.



Did you receive a legal complaint along with the summons?



Is there a case and file number listed CLEARLY and OBVIOUSLY by the court?



Second, I would call the county courthouse where you live and ask if there is a case pending against you. I would bet that there is no pending lawsuit. If that is the case, I would write a sternly worded letter to this %26#039;lawyer%26#039; telling them that they have violated the FDCPA (Fair Debt Collection Practices Act). If there is no case pending, I would suggest that you copy this letter that you received and send a copy to the attorney general%26#039;s office in the state where you live. If an attorney did send this to you, they are making some pretty serious errors!



A lawyer who sends you a letter saying he has sued you is a violation of the Fair Debt Collection Practices Act. This is tantamount to forging court documents in order to fool you into paying, and this is ILLEGAL. They can%26#039;t say that they will sue you unless they plan to do, and they can%26#039;t send you documents which look or resemble court documents or give the impression that they are so.



$600 is such a small amount of money in the grand scheme! It will cost than more to file a case in court and attorney%26#039;s fees. Most attorney%26#039;s on average about $185/hr (depending on their rates), and I find it doubtful that they would waste their money like that on $600.



You didn%26#039;t say, but has your debt been sold to a collection agency? I can%26#039;t see a bank suing for $600 unless you did something fraudulent like money laundering or lie to get your credit card.



You won%26#039;t go to jail, either.

First of all he can%26#039;t have you sent to jail for owing money. If you were in jail I wonder how he thinks you could even work on getting the money to pay the bill. But you cannot be took to jail for owing money. You can be sued and your wages garnished and stuff you own repo%26#039;d. Also you have other options that going to court. He can offer you a settlement, or repo your stuff, especially if you already agree to pay the debt what use would it be to take you to court anyway. All debt collectors and lawyers working for debt collectors are mean. How long has it been since he contacted you and told you that you had to goto court, because I think he is just bluffing. Even if you get served with papers you should be able to settle out of court. You should have CALLED the credit company, instead of mailing them, they can avoid letters but they can%26#039;t avoid phone calls as well. Also they are a thing called lawyer collection agencies, that%26#039;s where your account goes if a regular debt collector cannot collect on the account, the lawyer has the power to take you to court. I don%26#039;t understand though why your credit company would send your account to a lawyer first anyway. Usually having a lawyer try to collect on the account is like the last thing they do after the account has been in collection agencies. They will usually send accounts to another collection agency also if the first one couldn%26#039;t collect. I%26#039;d just tell that lawyer to go jump in a pond. He%26#039;s as full of it as a Christmas turkey. He%26#039;s just bluffing you more than likely.



Another thing is hiring a lawyer will only cost you more money. However if you can afford to do it, go for it, it MIGHT help you, The lawyer is most likely to get the lawyer in trouble, however I believe it is legal for them to send the account to a lawyer first, but thats not a typical thing they do, and taking you to court is not the first thing the lawyer does usually, they try to work out a settlement with you.

How old is this debt? Your credit card company obviously sold the debt to a collection agency. Did you actually receive a summons?



In the meantime, send a letter (don%26#039;t call or fax) to the lawyer offering to work out a settlement. If the debt is more than 4 years old, offer half. They would be more likely to accept if you offer a lump sum. Any payment arrangement would have to be short term -- less than 6 months. Get them to sign off on any settlement agreement and don%26#039;t give them access to your bank account.



If you do end up in court, the worse they can do is garnish a max of 25% of your wages.

Never ending credit card debt?

Been about 3-4 years of having credit cards and I spent a lot on getting my car fixed, college tuition, payments and what not. I have 4 now and a total credit limit of about 9000. I am maxed out on all of them and I pay a lot of over the limit and late fees. I have cut down my usage of credit cards to bare minimum now. I only use cash or my debit card to make all my purchases. All these late fees, overages are affecting my credit pretty badly. I am still pretty young in my early twenties but I want to get rid of this debt asap and then move on to graduate school and then owning a house. I am decent for somebody my age and have my own car. I can%26#039;t find a good way to pay off my credit card debt as it seems that they keep piling on the fees every other month or so. Any suggestions on how to get rid of this debt. I don%26#039;t want to talk to any credit counselors as they seem like manipulators as opposed to helpers to clear credit card debt. Thanks

Been there and can offer some advice.



First step: BREATHE. I am serious. Get yourself in the right frame of mind to devise a plan.



Now. Do you have every card able to be paid online? if not, sign up for online paying. This will help A LOT!! It will also save .42 every time you write a bill.



Next thing is to call all the credit cards and ask for a reduction. Tell them you were offered 0% for 12 month on another card. BTW, if you have, transfer the balance. This will allow you to keep the finance charges at $0 and the money will go towards your mission. Every %age point helps and It does not hurt to ask.



With a notebook and pen, sitting at table with no TV or radio on, write down all balances. Write down which are over the limit and which have been late in the past. Write down your minimum payment on each



Next is the plan of attack. First step is to get everything down from being over drawn. THIS IS A MUST or you will chase your tale. if 2 cards are over, make minimum payments on those that are not to help get the other down.



You will now have to change your life some to help with this. if you can find ways to save money, that can be transfered to your goal, you will be better off.



So where can you save money?



Do you buy coffee from D %26amp; D or 7-11? Stop. Start making it. = $1.75 / cup saving



Do you Smoke? Try and quit. $5.00 a pack saving



Buy Lunch every day? Bring lunch. The costs gets cut in half or in full if you eat leftovers.



Basically, you need to know what you buy and how much of it. So for a week, carry a notebook with you and your spouse (if there is 1). Write down everything you buy. When you do your grocery list, by store brands and cut out some of the discretionary stuff. The money saved will be very helpful!!



The plan in action.



You will be making multiple payments every month. Pick a card - I would start with the lowest balance. You have it set up online already so this will make it easy. Every 3 or 4 days, look at your checking account and make it to the nearest 10 by making a payment to your CC. if you 257.35, make a 7.35 payment to bring you to 150.00. You will be spending basically what you would have spent on discretionary stuff. You will not miss it. This will be ON TOPof your normal minimum payment (which is written down because it will change over time BUT not for you).



Attacking all cards at once will not motivate you because you will not see the progress. So just make minimum payments +$5 on the other cards. Think about it as a fight. Would you want to fight 5 people at 1 time or 1 person at a time but have 5 fights? You will lose the fight against the 5 people (probably) but have a chance to win 5 1 on 1 fights.



Here are some other tips:



Loose change - it adds up and usually not missed. Throw it into a jar. At the end of the month, bring it to the bank and make an additional payment.



eBay - have stuff you do not use? Sell it on eBay. make payments with the money received. Garage sales also work.



The overall key though is to decrease spending until you have everything under control. The cards should not even be in your wallet so there is no temptation. They are off limits.



These methods worked for me. I think they will do the same for you.

Also buckle down and give up a few luxuries to pay your debt. Like instead of going to the movies or eating out try saving that money. She lays everything out in clear, easy to understand language and gives you real solutions for budgeting, getting out of debt, using your credit wisely and raising your credit score. ALWAYS pay more than the minimum... remember there are finance charges, etc. And ALWAYS pay on time. I usually pay at least 5-7 days in advance so they have time to process it and it wont be late. If you pay before the due date you can avoid all those late charges, and cutting up the cards means no over the limit charges because you cant use the cards. You just have to put your foot down and do what you have to do.

With the late fees you will probably have a hard time paying on these, unless you can find a card that will do a balance transfer, with a low interest rate for a certain amount of time. PAY more than the minimums, in fact if you can set up your payments to get your cards paid off in a certain amount of time, preferably matching what your new credit card is for that is the smartest thing to do.



If you cannot do that, then pay the littlest card with the highest interest down, and then IGNORE that card. Pay the minimums to not get dinged a huge late fee on the other 3. Don%26#039;t charge anything to the little card once it is paid. Add the amount that you were paying to that card to the next littlest one and watch it snowball. Remember when you get these cards paid down to put that money that you have been paying each month into a savings account to cover expenses for the future things you want.



You need to also learn better spending habits, if you%26#039;re like most people, you feel if you have the credit you should use it. But you are better off to build your credit and ignore it. Only buy what you can afford to pay off in a month to 2 months time. If you cannot afford to do that, don%26#039;t put it on your card.



If you don%26#039;t have the income to pay the bills in a timely manner each month, than you might have to get creative with ways to come up with extra money. We are heading into the season of extra workers needed. Now is a great time to get a handle on the out of control debt. list all of your debt smallest to largest and pay min payments on all but the smallest. attack the smallest with a vengance. Then once its paid move to the next debt. the reason for this is it keeps you motivated. Interest rate is not the real problem. its your spending.



Stay away from these so called debt managment companies, debt consolidations companies. If they charge a fee then its a scam. What they will do is not pay your creditors for months and then try and settle for less. No special skills. they just dont pay,



Also, if they dont pay. You, and you alone are still responsible for the debt. Your creditors will come after you and not the companie you hired.



Its not gonna be easy but it will be worth it.

I have a situation where a USA credit recovery company has telephoned my wife saying that she owes a substantial amount of money on a UK credit card and they are going to start proceedings against her. I did not think that this type of debt (non commercial) could be collected from one contry to another like this. The debt was not in the States and to my way of thinking (right or wrong) the agreement between her and the credit card company was under UK credit law. You are a home owner, so know this important point. Weather you refinance in the future or sell your home and look to purchase a new home, your credit will be affected by doing business with a reduction agency. Mortgage lending banks categorize people who entered agreements with reduction agencies just the same as a person who filed for bankruptcy. You may ask how they will know. They know because when you enter to an agreement with them, every creditor that they reduced your debt with, reports that on your credit report. That will instantly put you in a bad position to get a new loan and one with a good interest rate in the future.



Also, know that you pay them a monthly service fee. Over time, the service fee will add up to the amount that they reduced from your overall credit cards. Hence, you will eventually pay the same amount in the end. I do know more than one person that has dealt with reduction agencies and after 2-3 years later, the amount of their credit cards has not made much progress in lowering the new reduced balance started 2-3 years before. I would start with a written budget. Put Food and the house at the top of the page. Along with utilities and transportation. Pay these top four first. If you dont have the money to pay the credit cards. Dont pay them. You need shelter and food and electric/heat.



Take a second job if you have too. Pile cash in the bank. The credit cards will settle with you for less down the road (6 -12 months).



Thats the same thing a debt reduction agency will do. No special skills. they just don%26#039;t pay. and they will charge you a fee to do it.

First, credit counseling may help, but for such a small amount it might not be worth it. They usually charge a fee. For $5k, you might end up spending more with that than you would just paying the interest on the cards till they%26#039;re paid off.



First, cut up the cards and do not use them anymore. Don%26#039;t spend a dime. Cancel any and all automatic payments on them and transfer those to a debit card.



You need to call the card you%26#039;re late on and explain the situation and see what they will accept if you make a few payments here and there every couple of weeks to catch up. Then get to a point where the account is in good standing. In the mean time, pay the minimum on the other.



Once you%26#039;re in good standing with both cards, look at the interest rates. Take the card with the highest rate (unfortunately, probably the highest balance) and begin to pay twice the minimum payment plus 10%, if you can afford it. Otherwise, just twice the minimum. Pay the minimum on the other card. Calculate what this amount is for the VERY FIRST MONTH. Pay that amount on that card each and every time, even though the minimum payment goes down.



Once this card is paid off, take the amount you were paying on it, add it to the minimum payment of the other card and pay this same amount each and every month until it%26#039;s paid off.



If you get a tax return or monitary gifts, put 10-30% of that towards the card you%26#039;re mainly paying off.



By the way, if the interest rates end up being the same on both cards, start paying the lower balance card off first, because you%26#039;ll pay that one off first and it%26#039;ll help motivate you. Plus it won%26#039;t put you in the poor house to pay twice that minimum plus 10% on that one.



DO NOT apply for another card, DO NOT use these cards, and DO NOT engage in any unneccessary spending (clothes, shoes, handbags, nice things, extravagant gifts for friends, going out to drink, etc) until after you%26#039;ve paid them off. If you want out of debt and your credit fixed, you need to understand you%26#039;re living beyond your means and must live way below them for a time until you can get your head above water.



NEVER stop paying on a debt. As long as you send in something, they can%26#039;t sue you or reposess anything, or even really damage your credit too bad. Late payments damage your credit score.

After that one time huge chunk of a payment. Try to make the minimum plus the finance charges as your payment. When a payment is made, the way it is applied is......it goes towards any fees and finance charges first....then it gets applied to your balance, so therefore by paying that huge chunk it will knock down your next minimum payments considerably and possibly the finance charges as well.

I am in just under 10,000 dollars in credit card debt. About 9,600 to be exact. I have controlled my spending habits as my debt used to be 15,000. All of this debt is on 4 credit cards. I am going to be going to school full time in August. I think I can get the debt down to 8,000 thousand before I go to school. The problem is I wont be able to work while I am at school. Frankly trying to pay a little bit on all 4 accounts is not a good idea. The collection agencies do not want to small payments strung out over long periods. That $50 is not even going to keep up with interest and fees on one card let alone all four. Small payments will just keep resetting the Statute of Limitations (SOL), the timeframe to bring lawsuit. The collection agency can take the small payment and sue you anyway.



Put the $50 aside and look for ways to bring in more cash -- garage sale, collect alum cans, second job. Collection agencies are more likely to work out a settlement for less if you have a lump sum. Also, the older the account the more likely they will settle for less. Any payment plan would have to be short term -- less than 6 months. Get any settlement agreement in writing, including any small payment plan. Do not give them direct access to your bank account.

I would say bad idea ...I think the smart move would be to consolidate and work down the balance from there. CC companies recently have been coming down hard on those who owe outstanding balances, there are even times when they will take you to small claims court, and there is also the fact that your credit will be shot.

If you take the 5k and divide it by 4, that%26#039;s about 1250 per cc. Paying 50/mnth would take you 2 years to pay off each card. The last one would expire off your credit report before you could even get to it. but it does sound like a plan....only if your current situation improves and you can up your payments eventually. 5k isn%26#039;t enough to file bankruptcy over..IMO. But if you start having problems paying your mortgage, then that is the better route. Also, this is all assuming that they aren%26#039;t adding interest/fees to your ccs as you are making payments. Why do you feel consolidation or bankruptcy is not an option. Neither of these options precludes you from paying the debt off, they are simply tools to get a handle on a run away situation. Of the two, consolidation is obviously your best choice. If you own a home and have equity in it, a home equity line of credit for $5000 is a very good option, and I%26#039;m sure the interest will be much lower than what the credit card companies are charging.



If that is not an option, negotiating with the credit card companies either directly or through their collection agents is your next option. Tell them they either need to accept your offer, or you will need to file for bankruptcy. Bankruptcy is a messy business for all parties involved, so they may be open to negotiation.



Worst case, filing bankruptcy will allow you to stave off the creditors with the help of the courts while you get back on your feet. The court will come up with a payment schedule that is reasonable for all parties. Filing bankruptcy wreaks havoc on your credit rating, and should be used as a last line of defense, but sometimes it%26#039;s necessary.

Also, bankruptcy is not the option it used to be. You will not be able to claim it. The bush Administration changed the laws in 2005 in favor of the credit card companies - making it more difficult for the individual in debt to file bankruptcy (which is viewed as a fianancial escape).



Consilidation companies take a fee. They say they don%26#039;t but will. They call it a manditory donation or something bogus like that, but they will take about 10% which would be $5 of your $50. what they do is essentially the same as what you can do yourself.



It%26#039;s all about negotiation. Some tips I can give are these:



1) Play the different agencies against each other. They all want money and will tell you different manditories but in reality there is no rule. They are just trying to get $ from you any way they can. You still have the power because you have what they want. So be strong in that fact. Tell one agency that another agreeded to your terms (don%26#039;t say what they are) and further say that if they can%26#039;t agree to your terms the money will fo to the other credit card (the other agency). Just say %26quot; seriously I cannot give anything more the $50%26quot; and stick to it. If they argue, say you will be happy to give it to the agency that is working with you.



2) Get another job and save like crazy. Are you pinching every penny possible? $5000 is not too bad, and you would be surprised how quickly you can save this working non-stop and not buying anything. Even if the jobs are shitty, swallow your pride and just get it done. Your life will be better in the long run.



I%26#039;m 29 now and a lawyer. I was a girl who loved buying clothes my freshman year of college. I racked up $8000 over 9 months that first year! It defaulted and was sent to agencies. Alternatively, you could ask your bank if they would give you a loan to repay the card. The rate of interest would be lower and you could pay the loan back over 2-3 years.

They helped up pay off a 13000 dollar debt by arranging to stop late fees and lower interest rates. You do have to agree to incurr no new credit during this time.
